Aryan Khan’s jail term extended: No bail today, hearing again on Thursday

The bail plea of Aryan Khan, son of Bollywood superstar Shah Rukh Khan, was heard on Wednesday in the drug case. However, the verdict has not been announced for the second day in a row. Now further hearing will be held tomorrow on Thursday. Hearing was also held on Tuesday but no decision came.

Arbaaz Merchant’s lawyer Amit Desai made the arguments during the hearing on Wednesday. He argued with the merchant, “I have six grams of charas but they are talking about 21 grams of charas.” As far as WhatsApp chat is concerned, there is nothing in WhatsApp chat that supports the conspiracy theory.

He said there was no mention of conspiracy anywhere in the memo when he was arrested on October 3. It’s just a matter of taking the medicine. Questioning the arrest, he said that where there was no conspiracy, there was a separate consumption case in the Panchnama, when there was no case, what was the need for arrest?

As soon as the hearing started, Amit Desai started reading Arbaaz’s arrest memo. Desai said three persons (Aryan, Arbaaz and Moonmoon Dhamecha) were arrested on the afternoon of October 3 for similar offenses without Section 27A and 29. They have been arrested only under sections 20(b) and 27. This means that they were only caught for taking drugs. Sections 27 and 20 (b) were to be included in the arrest memorandum. If there was no conspiracy on the assessment, the punishment was for one year and it is clear in the memorandum that there is no conspiracy.

“Four things are important for a crime,” Desai said. Purpose is the biggest crime. The conspiracy applies if the party was planned and the organizers had to provide. But it should also not be applied if the intake is intended as no medical examination was conducted after the arrest. We saw in the sessions court in the morning, two children were experimenting and both of them were from Odisha and their answer was the same. But today we read that he has got bail. They are the boys who were on the ship and later they left the ship and they enjoyed it. They later returned and were captured. He has got bail. That decision is not binding on this Court and I am not on equality and if there is no equality then I am at liberty.
