Debate: Nudity is a crime by law, should it be recognized?

Bollywood actor Ranveer Singh has found it costly to do a nude photo shoot for New York’s Paper magazine. An NGO in Mumbai filed an FIR against Ranveer at the Chembur Police Station. An FIR has been registered against Ranveer under sections 292, 293 and 509 of the IPC. Apart from this, a case has been registered in different sections of IT Actor. Time will tell how much the photo shoot will benefit Ranveer on the professional front.

In the complaint filed with the police by an organization called the Shyam Mangaram Foundation, it is also mentioned that Ranveer’s viral images on the internet are hateful and have a negative effect on us as a society.

After the pictures went viral, where on the one hand all Bollywood celebrities including his wife Deepika are supporting Ranveer’s ‘naked avatar’. So, on the other hand, there are many people who call this photo shoot vulgarity and say that Ranveer did this photo shoot for the purpose of getting cheap publicity. Through this photo shoot, he has tried to pamper the country’s society and culture. Whatever Ranveer’s intentions were before doing the photo shoot, social media has split into two factions. From all the brainstorming, only one question arises: should nudity, which is currently a crime by law, be recognized?

The arguments of the supporters of nudity-

People who are in favor of nudity have different arguments in light of the matter. Those people believe that a democratic nation should allow free speech. If someone wants to remain nude, that should also be allowed, yes, if the challenge of law and order arises, proper arrangements should be made for that too. Some people also gave examples from Naga sadhus, that nudity is already allowed in our society. In such a situation, if it becomes legal, then there is no harm in it.

Those who are against nudity-

Those who oppose nudity in India stress that we must take sex education seriously in the first place. If nudity is legalized in India, crimes against women will increase.

Some people also opposed nudity in a philosophical way. That nudity will not cease to exist between men and women, and that there will come a time when people will lose attraction to the opposite sex. Pranksters also said imagine Indians out of shape or with paunches if they walk barefoot through the streets, how terrible will the scene be?

The Indians are not yet mature enough to handle such freedom. It is also said that laws can be made, but people’s mentality cannot be changed. This will create chaos on the roads.

Above we have seen the arguments of both the people, that is, both those who support and those who oppose nudity in India. Now the people themselves should decide whether nudity should be legal in a country like India or not. At the same time, the public should also say whether it is the need of the hour to ignore such images in the name of freedom of expression.

What does the law say about nudity?

IPC Section 292- There is a prison provision of up to 2 years and a fine of up to Rs 2,000 for selling material such as pornographic books, etc. Repeating the same offense can be punishable by 5 years in jail and a fine of Rs 5,000.

Section 293 of IPC- There is a provision to be punished with imprisonment for up to 3 years and a fine of up to Rs 2,000 for selling obscene articles, etc., to young people. If the same offense is repeated, the prison sentence is 7 years and the fine can be increased to Rs 5,000.

IPC Section 294- For obscene acts and songs, up to three prison sentences have been prescribed, as well as fines.

Section 67 of the Information Technology Act, 2000- Obscenity or nudity in electronic form is punishable by imprisonment for up to 5 years and a fine of up to Rs 1 lakh. If he pleads guilty again, it can be commuted to a prison sentence of up to 10 years and a fine of up to Rs 2 lakh.
