During the hearing, advocate Mukul Rohatgi argued that NCB did not get anything from my client Aryan Khan and it does not appear that he has taken any drugs. So the question of arresting my client does not arise. He also questioned the NCB officials and said, ‘In many petitions we have questioned that these officers are not even police officers, they are using the power of the police. That’s why he said that he has the power to make arrests.
Rohatgi said, “Nothing has been found from Aryan Khan nor any medical examination has been done to show that he has taken any medicine.” 6 grams of charas was found in Arbaaz Merchant’s shoes. Merchant has denied this. I don’t care about him, he’s just my friend.
He referred to the Supreme Court’s decision in the Tofan Singh case last year which held that NDPS officers were police officers and the statements given to them cannot be used as evidence in court. The statement recorded by NDPS is not valid in the court.
Six grams of charas has been found. So this is a very small amount which is not enough to keep me in custody. Many others have found intermediary and commercial volume. Section 27A has not been imposed on me. Section 73 cannot be applicable in my case. When it comes to WhatsApp chat, it is 2018. None of them are related to chat cruise. Rohatgi said that it seems that this conversation has nothing to do with the present matter.
